Dohodnut\u00e9 zn\u011bn\u00ed rovn\u011b\u017e zav\u00e1d\u00ed v\u016fbec prvn\u00ed pravidla EU t\u00fdkaj\u00edc\u00ed se algoritmick\u00e9ho \u0159\u00edzen\u00ed a vyu\u017e\u00edv\u00e1n\u00ed um\u011bl\u00e9 inteligence na pracovi\u0161ti.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.gnews.cz\/wp-content\/uploads\/2024\/02\/20190207PHT25322-cl-1-1024x500.jpg\" alt=\"\" class=\"wp-image-5048\"\/><\/figure>\n\n\n\n<p>Status zam\u011bstnance<\/p>\n\n\n\n<p>Nov\u00fd pr\u00e1vn\u00ed p\u0159edpis zav\u00e1d\u00ed domn\u011bnku zam\u011bstnaneck\u00e9ho pom\u011bru (na rozd\u00edl od samostatn\u00e9 v\u00fdd\u011ble\u010dn\u00e9 \u010dinnosti), kter\u00e1 se uplatn\u00ed, pokud jsou p\u0159\u00edtomny skute\u010dnosti sv\u011bd\u010d\u00edc\u00ed o kontrole a \u0159\u00edzen\u00ed podle vnitrost\u00e1tn\u00edho pr\u00e1va a platn\u00fdch kolektivn\u00edch smluv, jako\u017e i s p\u0159ihl\u00e9dnut\u00edm k judikatu\u0159e Evropsk\u00e9ho soudn\u00edho dvora.<\/p>\n\n\n\n<p>Sm\u011brnice ukl\u00e1d\u00e1 zem\u00edm EU povinnost zav\u00e9st na vnitrost\u00e1tn\u00ed \u00farovni vyvratitelnou pr\u00e1vn\u00ed domn\u011bnku zam\u011bstnaneck\u00e9ho pom\u011bru s c\u00edlem napravit nerovnov\u00e1hu moci mezi platformou a osobou vykon\u00e1vaj\u00edc\u00ed pr\u00e1ci na platform\u011b. M\u00edsto toho mus\u00ed platformy zajistit lidsk\u00fd dohled nad d\u016fle\u017eit\u00fdmi rozhodnut\u00edmi, kter\u00e1 maj\u00ed p\u0159\u00edm\u00fd vliv na osoby vykon\u00e1vaj\u00edc\u00ed pr\u00e1ci v platform\u011b.<\/p>\n\n\n\n<p>Transparentnost a ochrana \u00fadaj\u016f<\/p>\n\n\n\n<p>Sm\u011brnice zav\u00e1d\u00ed v\u00edce ochrann\u00fdch pravidel pro pracovn\u00edky platforem v oblasti ochrany \u00fadaj\u016f. Platformy budou m\u00edt zak\u00e1z\u00e1no zpracov\u00e1vat ur\u010dit\u00e9 typy osobn\u00edch \u00fadaj\u016f, nap\u0159\u00edklad o osobn\u00edm p\u0159esv\u011bd\u010den\u00ed a soukrom\u00fdch v\u00fdm\u011bn\u00e1ch s kolegy.<\/p>\n\n\n\n<p>Text rovn\u011b\u017e zvy\u0161uje transparentnost t\u00edm, \u017ee ukl\u00e1d\u00e1 platform\u00e1m povinnost informovat pracovn\u00edky a jejich z\u00e1stupce o tom, jak funguj\u00ed jejich algoritmy a jak chov\u00e1n\u00ed pracovn\u00edka ovliv\u0148uje rozhodnut\u00ed p\u0159ijat\u00e1 automatizovan\u00fdmi syst\u00e9my.<\/p>\n\n\n\n<p>Platformy budou muset p\u0159ed\u00e1vat informace o samostatn\u011b v\u00fdd\u011ble\u010dn\u011b \u010dinn\u00fdch osob\u00e1ch, kter\u00e9 zam\u011bstn\u00e1vaj\u00ed, p\u0159\u00edslu\u0161n\u00fdm vnitrost\u00e1tn\u00edm org\u00e1n\u016fm a z\u00e1stupc\u016fm pracovn\u00edk\u016f platforem, jako jsou odbory.<\/p>\n\n\n\n<p>Citace:<\/p>\n\n\n\n<p>Zpravodajka Elisabetta Gualmini (S&amp;D, IT) uvedla: &#8222;Po mnoha hodin\u00e1ch jedn\u00e1n\u00ed jsem r\u00e1da, \u017ee jsme dnes dos\u00e1hli p\u0159edb\u011b\u017en\u00e9 dohody. V\u011bt\u0161\u00ed transparentnost a odpov\u011bdnost algoritm\u016f a v\u011bt\u0161\u00ed ochrana \u00fadaj\u016f pracovn\u00edk\u016f platforem by se m\u011bly st\u00e1t skute\u010dn\u00fdm m\u011b\u0159\u00edtkem na celosv\u011btov\u00e9 \u00farovni. Zajistili jsme, aby a\u017e 40 milion\u016f pracovn\u00edk\u016f platforem v Evrop\u011b m\u011blo p\u0159\u00edstup ke spravedliv\u00fdm pracovn\u00edm podm\u00ednk\u00e1m.&#8220;<\/p>\n\n\n\n<p>Drago\u0219 P\u00eeslaru (Renew, RO), p\u0159edseda V\u00fdboru pro zam\u011bstnanost a soci\u00e1ln\u00ed v\u011bci, uvedl: &#8222;Je to velmi d\u016fle\u017eit\u00e9. Jm\u00e9nem v\u00fdboru tuto p\u0159edb\u011b\u017enou dohodu v\u00edt\u00e1m. Byla uzav\u0159ena t\u00e9m\u011b\u0159 na konci prodlou\u017een\u00e9ho \u010dasu a je to posledn\u00ed p\u0159\u00edle\u017eitost, jak splnit jeden z kl\u00ed\u010dov\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f, kter\u00e9 jsou sou\u010d\u00e1st\u00ed soci\u00e1ln\u00edho pil\u00ed\u0159e. Tato dohoda zlep\u0161\u00ed pracovn\u00ed podm\u00ednky v ekonomice platforem a zv\u00fd\u0161\u00ed transparentnost a odpov\u011bdnost \u0159\u00edzen\u00ed algoritm\u016f na pracovi\u0161ti.&#8220;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.gnews.cz\/wp-content\/uploads\/2024\/02\/20190620PHT54916-cl-1024x435.jpg\" alt=\"\" class=\"wp-image-5049\"\/><\/figure>\n\n\n\n<p>Dal\u0161\u00ed kroky<\/p>\n\n\n\n<p>Aby dohodnut\u00e9 zn\u011bn\u00ed vstoupilo v platnost, bude nyn\u00ed muset b\u00fdt form\u00e1ln\u011b p\u0159ijato Parlamentem i Radou.<\/p>\n\n\n\n<p>Souvislosti<\/p>\n\n\n\n<p>Anal\u00fdza Evropsk\u00e9 komise z roku 2021 zjistila, \u017ee v sou\u010dasn\u00e9 dob\u011b je aktivn\u00edch v\u00edce ne\u017e 500 platforem digit\u00e1ln\u00ed pr\u00e1ce a \u017ee toto odv\u011btv\u00ed zam\u011bstn\u00e1v\u00e1 v\u00edce ne\u017e 28 milion\u016f lid\u00ed &#8211; do roku 2025 by tento po\u010det m\u011bl dos\u00e1hnout 43 milion\u016f.
