A copy of the agreement, the authenticity of which has been confirmed by The Times of Israel, lists how many Palestinian prisoners Israel must release per prisoner released and details the terms of Israel's withdrawal from Gaza.
Below is the text of the ceasefire agreement between Israel and Hamas that was reached on January 15, 2025. A copy of the text, obtained by ToI and confirmed as authentic by an Arab diplomat familiar with the negotiations, did not include several other annexes containing maps and other details describing the parameters of the agreement.
The text below, entitled APPENDIX I, adds Israel's draft agreement with Hamaswhich was submitted on 27 May 2024 and publicly presented by the US President on 31 May 2024 Joe Biden. This proposal provides for a three-phase agreement 'on the exchange of hostages and prisoners and the restoration of a sustainable calm' and envisages the release of 33 Israeli hostages in the first phase. In its announcement of the agreement of 15 January 2025 Biden clarified: "This is the exact framework of the agreement I proposed back in May."
APPENDIX I
Practical procedures and mechanisms to implement the agreement on the exchange of Israeli hostages and Palestinian prisoners and a return to a permanent ceasefire between the two sides
1. Second phase of preparation:
The parties and the mediators aim to reach a final agreement on the implementation of the 27 May 2024 agreement on the exchange of hostages and prisoners and a return to a permanent ceasefire between the two sides.
All the procedures in the first stage will continue in the second stage while negotiations on the modalities for the implementation of the second stage are ongoing, and the guarantors of this agreement will endeavour to keep the negotiations going until an agreement is reached.
2. Withdrawal of Israeli forces:
Withdrawal of Israeli forces eastwards from densely populated areas along the Gaza Strip border, including Wadi Gaza (Netzarim axis and Kuwait roundabout).
Israeli forces will be deployed within a perimeter of (700) meters, except at five localized points, which will be increased by a maximum of an additional (400) meters, to be determined by the Israeli side, south and west of the border, based on maps agreed by both sides and annexed to the agreement.
3. Prisoner exchange:
Nine of the sick and injured on the list of 33 will be released in exchange for the release of 110 Palestinian prisoners with life sentences.
As of 8 October 2023, Israel will release 1,000 Gazan detainees who were not involved in the events of 7 October 2023.
Older persons (men over 50 years of age) on the list of 33 will be released in exchange for a 1:3 exchange key to life sentences + 1:27 to other sentences.
Avera Mengistu and Hisham al-Sayed - will be released on a 1:30 swap basis, as will Shalit's 47 prisoners.
A number of Palestinian prisoners will be released abroad or in Gaza on the basis of lists agreed between the two sides.
4. Philadelphia Corridor:
The Israeli side will gradually reduce forces in the corridor area during Phase 1 based on the attached maps and the agreement between the two sides.
After the release of the last hostage in the first stage, on Day 42, Israeli forces will begin the withdrawal and complete it no later than Day 50.
5. Rafah border crossing:
After the release of all women (civilian and military), the Rafah border crossing will be ready for the movement of civilians and wounded. Israel will work on the readiness of the crossing as soon as the agreement is signed.
Israeli forces will deploy around the Rafah crossing according to the attached maps.
50 wounded soldiers accompanied by (3) persons will be able to cross the crossing daily. Each individual crossing will require the consent of Israel and Egypt.
The crossing will be operated on the basis of the August 2024 negotiations with Egypt.
6. Disembarkation of sick and wounded civilians:
All sick and injured Palestinian civilians shall be allowed to cross the Rafah crossing in accordance with paragraph 12 of the 27 May 2024 Agreement.
7. Return of unarmed IDPs (Netzarim Corridor):
The return is agreed to pursuant to Section 3-a and 3-b of the May 27, 2024 Agreement.
On the seventh day, the IDP pedestrians will be allowed to return north, without carrying weapons and without checking Rashid Street. On the 22nd, they will also be allowed to return north along Salah a-Din Street, without checks.
On the seventh day, vehicles and all non-pedestrian traffic will be allowed to return north of the Netzarim corridor following an inspection of the vehicles by a private company to be appointed by the intermediaries in coordination with the Israeli side on the basis of an agreed mechanism.
8. Protocol on Humanitarian Aid:
Humanitarian assistance under the Agreement will be provided on the basis of an agreed humanitarian protocol under the supervision of intermediaries.
