The President of the Czech Republic, Petr Pavel, stated in an interview with Radiožurnál on Národní třída that his appointment of Andrej Babiš as Prime Minister could "contribute to the creation of an illegal situation," if the leader of the ANO movement is unable to adequately explain and resolve his conflict of interest. He warned that if Babiš still owns the Agrofert holding company at the time of his appointment, he would be in direct violation of the law on conflicts of interest.
According to Pavel, the key is not that the candidate for Prime Minister has everything resolved before the appointment itself, but that he is able to present a clear plan. Radiožurnál quoted the President's words, stating that he expects a period of approximately thirty days during which Babiš must provide evidence that he has no control over Agrofert. The President believes that a transparent process is essential for assessing whether his appointment would be in compliance with the legal system.
The debate about Babiš's conflict of interest has been one of the longest-running political issues of the past decade. In the past, Babiš has repeatedly stated that he is prepared to resolve the conflict of interest in order to be able to perform a potential government function without legal doubts. However, it is not clear how he intends to do so now, given that he has once again claimed ownership of Agrofert after years.
Pavel claims that his position is not directed against a specific person, but stems from the obligation to protect the public's trust in the rule of law. As Radiožurnál interpreted the President's words, the Presidential Office will insist that the highest constitutional office not be held under a cloud of doubt.
